Purchases made by our users through our website (“Website”) are governed by the conditions (“The Conditions”) described below. The purchase of products (“Product”) through restaurantedonaire.com implies full and unreserved acceptance by the user of the following conditions of purchase. The Conditions do not cover the purchase of our products by third parties outside the Web Site.

Please read these Terms carefully before placing an order for any “Product” on our “Web Site”. If you do not agree to these Terms, you may not place an order for any Product on our Website. You may print a copy of these Conditions for future reference.

  1. Possibility of modification of the present conditions and the commercial offer

EXPLOTACIONES SANTONEL, S.L. may modify at any time the conditions or offers published in its Web Site (prices, products, promotions, and other commercial and service conditions). But the modifications will not affect in any case the purchases already made by our users.

The names and brands of products and manufacturers are used only for identification purposes. All photos, descriptions and prices are not contractual.

Special offers, promotions or discounts will be valid until the date indicated or until the end of the number of stock indicated. As well as the prices indicated at the time of consultation of the website.

  1. How can I buy on the website?

The purchase by the user is carried out and perfected by following the purchase procedure described in this section. When making a purchase in our web, you accept that the communications with EXPLOTACIONES SANTONEL, S.L. will be mainly by electronic means.

To proceed to make a purchase in our web you only have to follow the following steps:

  1. In order to make purchases through our web, the user will have to access one of the three options provided.
  2. Once chosen they will be able to add to the cart the order, or, to select that the card is a gift card.  If the order is made for a gift card, the user will have to fill in the form requested by the web. 
  3. Once the cart is completed with the desired order, you must select finalize the purchase.
  4. In the section of finalizing the purchase, the invoicing data must be completed, select to pay with card and place the order.
  5. The user must enter the data of his card to finalize the purchase. 

The purchase is confirmed when the thank you for your order page appears and you receive a confirmation email. 

  1. How long will it take to receive your order?

    Once the payment has been made, either with the card code or in a gift menu, the order will be delivered automatically, always taking into account the preparation time of the products.

    4. Method of payment

    4.a) What payment methods can I use?

    The payment of the order and/or the gift card will be made by credit card.

    5. What are the invoices like?

    The user accepts that the invoices for the purchases of the products are issued electronically and sent by e-mail. You can request a paper copy of the invoice by sending an email to protecciondedatos@grupofedola.com.

6.a) How long do I have to cancel the purchase or decide to return the card?

The user will have a period of 14 calendar days to cancel the purchase and return the gift card purchased, as long as it has not been used. 

6.b) How can I cancel the purchase?

The withdrawal will have to be communicated to EXPLOTACIONES SANTONEL, S.L. within the term previously established through the form included in the web page or, if applicable, by e-mail to the address donaire@gfvictoria.com.

If the withdrawal is not made in the way included in the present conditions, it will not be understood as formalized.

6.c) What are the requirements for exercising the right of withdrawal?

The requirements to make effective the withdrawal will be to have a Gift Card that has not been used previously and that has been acquired in the last 14 calendar days. Once the order has been placed in our facilities, the withdrawal will not be accepted. 

6.d) How is the refund made? 

When you proceed to the withdrawal of the purchase will be refunded in the same way in which the payment was made. 

 

  1. Legal Warranty  

The products sold by EXPLOTACIONES SANTONEL, S.L. are covered by the legal guarantee from the delivery in the new products or services in charge of the seller, according to what is foreseen in the consumers and users regulations.

The legal guarantee will be covered as follows:

Material goods: 3 years

We do not cover defects caused by misuse, negligence or improper handling. The “Products” or “services or digital content” sold on our Web Site are intended only for the use described in the specifications of each product, service or digital content.

  1. Cause of force majeure

EXPLOTACIONES SANTONEL, S.L. shall not be liable for any failure or delay in the performance of any of the obligations assumed, when the same is due to events beyond our reasonable control (“Force Majeure Cause”). 

Force Majeure Events shall include any act, event, failure to exercise, omission or accident beyond our reasonable control such as a) Strikes, lockouts or other industrial action; b) Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war; c) Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster; d) Impossibility of use of means of transportation; Impossibility of use of telecommunications systems; and e) Governmental acts, regulations or restrictions.

The obligations under these terms and conditions shall be suspended during the period of Force Majeure and we will extend the time to perform such obligations for a period of time equal to the duration of the Force Majeure and we will use all reasonable efforts to terminate the Force Majeure or to find a solution that will allow us to perform our obligations despite the Force Majeure.

  1. Partial nullity

If any of these Conditions is declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force, without being affected by such declaration of nullity.

  1. Applicable law and competent courts

Contracts for the purchase of products through our Web Site and any disputes or claims arising therefrom or relating to their subject matter or conclusion (including non-contractual disputes or claims) shall be governed by Spanish law.

Any dispute arising out of or relating to the use of the website or the products shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals of the province of Santa Cruz de Tenerife.

If you are contracting as a consumer, nothing in this clause shall affect your rights as a consumer under current legislation, and you may choose to file a claim to enforce your rights in relation to these Conditions before the Judge or Courts corresponding to your domicile.
